Terms & Conditions

Please read these terms carefully. By creating a TrackInn account or using our platform, you agree to be bound by these Terms & Conditions. If you disagree with any part, you must not use our services.

1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Guest", "User", or "Subscriber") and TRACKINN Technologies Pvt. Ltd. ("TrackInn", "we", "us"). By registering an account, accessing, or using any part of the TrackInn platform, you confirm that:

  • You are at least 18 years of age and legally capable of entering a contract.
  • You have read and agree to these Terms and our Privacy Policy.

2. Our Services

TrackInn provides a hotel booking platform that includes:

  • Hotel search and discovery across Odisha and India
  • Online room booking with advance payment via Razorpay
  • Guest profile, KYC document management, and family member registration
  • Digital check-in for a seamless hotel experience
  • Booking management (view, cancel, track status)
  • Integration with SARAI-compliant hotel properties

We reserve the right to modify, suspend, or discontinue any feature with 30 days' notice to registered users. Critical security updates may be deployed without notice.

3. Accounts & Access

  • You are responsible for all activity under your account.
  • You must provide accurate, complete, and current information during registration.
  • You are responsible for maintaining the confidentiality of your password. Do not share login credentials with unauthorized persons.
  • You must promptly notify us at support@trackinn.in if you suspect any unauthorized access to your account.
  • We reserve the right to suspend accounts suspected of fraudulent activity without prior notice.

4. Payments & Billing

  • Advance Payment: Bookings require a 20% advance payment at the time of booking. The remaining 80% is paid directly at the hotel during check-in.
  • Platform Fee: A 10% platform commission is included in the total booking amount, plus 18% GST on the commission.
  • Payment Processing: Payments are processed via Razorpay. By booking, you authorize the payment through the selected payment method.
  • Refunds: Cancellation refunds are processed within 5-7 business days to the original payment method, subject to cancellation policy.
  • All prices are in INR (Indian Rupees).

5. Acceptable Use Policy

You agree NOT to use the TrackInn platform to:

  • Provide false or fraudulent KYC information or booking details.
  • Make bookings with no intention of staying (fraudulent reservations).
  • Reverse-engineer, decompile, or attempt to extract the source code of our software.
  • Use automated bots or scripts to scrape data from the platform.
  • Upload malware, viruses, or any malicious code.
  • Violate any applicable law, including the IT Act 2000, DPDP Act 2023, or GST regulations.

Violation of this policy may result in immediate account suspension and legal action.

6. Data & KYC

  • Your Data: You retain ownership of your personal and KYC data. We act as a data processor on your behalf.
  • SARAI Compliance: Guest KYC data is transmitted to hotel properties for SARAI Act compliance as required by the Ministry of Tourism.
  • Data After Account Deletion: Upon account deletion, your data is retained for 90 days (for recovery) then deleted, except where legal retention is required.

7. Intellectual Property

All software, designs, trademarks, logos, and content on the TrackInn platform are the exclusive property of TRACKINN Technologies Pvt. Ltd. and protected by Indian Copyright Act, 1957 and applicable international IP laws.

You are granted a limited, non-exclusive, non-transferable license to use the platform for personal hotel booking purposes. This license does not grant you ownership of any TrackInn intellectual property.

8. Limitation of Liability

To the maximum extent permitted by law:

  • TrackInn acts as a booking intermediary. We are not responsible for the quality, safety, or condition of hotel properties listed on our platform.
  • We are not liable for any indirect, incidental, special, or consequential damages including loss of revenue, business interruption, or data loss.
  • We do not guarantee uninterrupted service. While we target 99.9% uptime, planned maintenance may cause brief downtime with prior notice.
  • Disputes between guests and hotels regarding stay quality, amenities, or services should be resolved directly with the hotel property.

9. Cookies, Local Storage & Tracking Technologies

By using TrackInn, you consent to the use of cookies and similar technologies as described below:

9.1 Essential Cookies

  • Session Cookie (sessionid): Required to keep you logged in while using the platform. Expires when you close your browser or after 14 days of inactivity.
  • CSRF Cookie (csrftoken): Protects against cross-site request forgery attacks. Required for all form submissions.

9.2 Third-Party Cookies

  • Google Sign-In: When you use "Sign in with Google", Google may set cookies on your browser. These cookies are governed by Google's Privacy Policy.
  • Razorpay: During payment processing, the payment gateway may set cookies to secure the transaction. Governed by Razorpay's Privacy Policy.
  • No Advertising Cookies: We do not use Google Ads, Meta Pixel, or any third-party advertising or retargeting cookies.

9.3 Managing Cookies

You can manage or delete cookies through your browser settings. Note that disabling essential cookies will prevent you from logging in or using the platform.

10. Third-Party Authentication (Google Sign-In)

TrackInn offers "Sign in with Google" as a convenient authentication method. By using this feature, you agree to the following:

  • Data Shared by Google: When you sign in with Google, we receive your name, email address, and profile picture from your Google account. We do not receive your Google password.
  • How We Use This Data: Your Google profile information is used solely to create and authenticate your TrackInn account. We do not access your Google Drive, Gmail, Calendar, or any other Google services.
  • OAuth 2.0 Scopes: We request only the minimum scopes needed -- openid, email, and profile. No additional permissions are requested.
  • Account Linking: If you sign in with Google using an email that matches an existing TrackInn account, the accounts will be linked automatically.
  • Revoking Access: You can revoke TrackInn's access to your Google account at any time via Google Account Permissions. This will not delete your TrackInn account but will prevent future Google Sign-In.
  • Google's Terms: Your use of Google Sign-In is also subject to Google's Terms of Service and Google's Privacy Policy.

11. Termination

  • By You: You may delete your account at any time from your profile settings or by contacting support.
  • By TrackInn: We may suspend or terminate your account immediately for serious policy violations or fraudulent activity.
  • Effect of Termination: Upon termination, your access to the platform ends. Existing confirmed bookings remain valid and must be honoured by the hotel.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka, India.

Before initiating legal proceedings, both parties agree to attempt good-faith resolution through negotiation or mediation for a period of 30 days.

13. Changes to These Terms

We may update these Terms periodically. We will notify all registered users via email at least 30 days before material changes take effect. Continued use of the platform after the effective date of changes constitutes your acceptance of the updated Terms.
